4.3.2 Requirements
- Clause 4.3.2 requires the organization to have procedures to “identify and have access to” two types of requirements:
- Environmental legal requirements (e.g., governmental regulatory requirements); and
- “Other Requirements” that the organization or site has adopted and that apply to facility operations.
Under ISO 14001, both types of requirements have equal weight and must
be complied with.
*The standard requires that a determination be made as to how legal and other
requirements apply to the environmental aspects (not just significant) and how legal requirements are taken into account when establishing, implementing and maintaining the EMS.
